MPNA defeats T-Mobile
pole permit with community cooperation,
sets important precedent for future permit requirements telecom companies.
MPNA lead the fight to stop T-Mobile from obtaining a Coastal Development Permit (CDP) from the California Coastal Commission. T-Mobile installed a new telephone pole and cell phone transceiver without meeting basic requirements for permitting from the CCC. MPNA caught T-Mobile installing this unpermitted pole in April of 2007 and started proceedings against T-Mobile immediately thereafter. MPNA also determined that there are also significant gaps in LA City permit control over the installation of new telephone poles that we are working to close in cooperation with Council District 11. At the hearing, the Commissioners heard from Mark Winter of MPNA, Bill Rosendahl of CD11, Marcia Hanscom of the Coastal Legal Action Network (CLEAN) and other citizens concerned about the possibility of a retroactive CDP when T-Mobile clearly violated the permit process. Eleven of the twelve Commissioners commented that (a) applicants should not be allowed to skirt the permit process and ask for retroactive permits, and stated that (b) T-Mobile did not demonstrate that it had fully investigated alternative siting or co-location as required by the Coastal Act. The Commissioners also found that the pole had a negative impact on the Environmental Sensitive Habitat Area (ESHA) of the Grand Canal. CLEAN, in cooperation with MPNA, has filed an enforcement action against T-Mobile to remove the pole which is the next step. MPNA has reached out to T-Mobile to work with them alternative locations to expedite removal of the pole and equipment from the adjacent Grand Canal.

Quick Report 2009:
We have had success on the vacant lots along the Canal. The city council are voting on it and it is in the process of transfering to the Recreation and Parks Department, as official public park space. The first one that has gone through is on the east side of the Canal on Driftwood. We now qualify for the Quimby funds that we have long sought after to bring back to the community.
The Eruv, the plan to run a wire and poles down our beach, we stopped through legal and political action.
We caught T-Mobile installing an illegal telephone pole and are successfully in the process of removing it.
We have secured commitments from the Council office to begin repaving our streets.
We also coordinated a community security service to patrol the Peninsula.

Security Service Systems began their patrol of the peninsula today with a bicycle and also a black sedan with the security company logo
on it. Any deterrent to crime would benefit the entire area. We need 157 subscribers for an 8-hour patrol seven days a week.

which included LAPD Senior Lead Officer Robin Richards, Security Service Systems President George Aceves, Nancy Marino from WEAREMDR, and Arturo Pena from the Council District 11 office. George Aceves
has agreed to a huge discount for condominium HOAs with 4 units or more. This means that the entire building will have the service, and it can be paid from your HOA dues. Condos with 4 units or more will pay $10/month/unit. So for example, in a building with 10 units, it would only cost $100 per month, paid quarterly ($300).
Arturo Pena took questions from the residents regarding a variety of issues. Then we had the security presentation, a status of the Canal Restoration project, and then Nancy Marino gave a comprehensive update regarding County projects at various parcels in the Marina proper. We finished
with a question and answer session for members and attendees.

QUIMBY FUNDS
MPNA has made a breakthrough on keeping the empty lots in the Marina Peninsula as possible recreation areas for Marina Peninsula residents. MPNA has been querying the 11th Council District office, and the L.A. City Controller's office for almost a year regarding the "Quimby" funds (which begun in 1975 for parks and recreation areas), with absolutely no response til now.
It took a recent L.A. Times article to bring the subject to light, and the fact that there is almost $12 million which has not been used in the CD11 district alone. Read about it here, and send us your feedback about possible sites for park-like improvements. We have several sites on the peninsula that we feel could be greatly improved with very little money.

STREET REPAIRS
After months of trying to get an answer for the street repair schedule, board member Mark Winter has been informed by the city that street repairs will begin on Strongs Drive beginning this fall.

LEAST TERN RESERVE
The least terns have experienced record numbers of fledglings over the past two years, due in no small part to the work of the L.A. Audubon Society volunteers. The presence and health of the birds in our area are a direct reflection of the state of our environment.

CANAL IMPROVEMENTS BEGIN THIS SUMMER
Mark Winter tells us the following regarding canal improvements from Washington Blvd. to Hurricane St.: "We've completed a review of the 50% stage of the
design study by Psomas, the environmental and engineering consultant hired by the City. MPNA is a member of the Advisory committee that oversees this project. The result of the
study thus far is very positive and the next step will be a broad-based meeting with the community overall to present the plans".
GRAFFITI WALL RESTRICTIONS
Permits are now required to paint on the Venice grafitti wall, as of June 3rd 2008 and only on weekends. Hopefully, we will see a decrease in collateral
tagging all over Venice. Report any grafitti immediately. If your building have been tagged recently, please contact info@marinapeninsula.org Please take pictures of any graffiti and erase it immediately. E-mail us and we will forward the ".jpg" files to
LAPD. Excessive damage from graffiti constitutes a felony.
